Florida Legal Foundation has joined forces with the Institute for Justice and Americans for Prosperity to challenge the levy of $165,000 in fines by the Town of Lantana against a hard-working single mother raising young children for trivial code violations at her home -- a downed fence, a cracked driveway, and, most recently parking her car on a swale out of necessity – that she cannot afford to pay. We allege the fines are unconstitutional under the Excessive Fines Clause of the Florida Constitution. The challenge is pending in the Florida Supreme Court. Florida Legal Foundation has also initiated a call on the Florida Bar to justify the requirement it imposes on all members of the Florida Bar to take continuing education courses. There are more than 100,000 members of the Florida Bar. Each is required to complete on average 10 hours of CLE per year for a total of more than !,000,000 hours per year, excluding choosing courses, tuition expended by those who may seek relevant courses, and post-course reporting. Florida Legal Foundation wants the Florida Bar to justify the imposition. Other states have undertaken to do so.
